These Terms and Conditions (“Terms”) govern your access to and use of the websites located at www.crebbgroup.com and www.cincycre.com, our SMS/text messaging program, and any related pages, content, or services (collectively, the “Services”) operated by Kitzberger Real Estate Sales Services LLC, doing business as CREBB Group (“CREBB Group,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.

1. Acceptance of Terms

By accessing, browsing, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with any additional terms, policies, or guidelines referenced herein. These Terms constitute a legally binding agreement between you and CREBB Group.

2. Eligibility

You must be at least 18 years of age to use the Services, including our SMS/text messaging program. By using the Services, you represent and warrant that you are at least 18 years old and that you have the legal capacity to enter into these Terms.

3. Use of the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Services in any manner that violates any applicable federal, state, local, or international law or regulation;
Attempt to gain unauthorized access to, interfere with, damage, or disrupt any part of the Services, the servers on which they are hosted, or any connected systems or networks;
Use any robot, spider, scraper, or other automated means to access or copy content from the Services without our prior written permission;
Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services for any commercial purpose without our express written consent;
Introduce any viruses, malware, or other material that is malicious or technologically harmful; or
Impersonate or attempt to impersonate CREBB Group, an employee, another user, or any other person or entity.

4. Intellectual Property

The Services and all content, features, and functionality — including but not limited to text, graphics, logos, images, the CREBB Group name and marks, and the design and arrangement of the foregoing — are owned by CREBB Group or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. No right, title, or interest in or to the Services is transferred to you, and all rights not expressly granted are reserved by CREBB Group.

5. No Brokerage or Professional Relationship

The Services provide general information about commercial real estate and business brokerage. Nothing on the Services creates a brokerage, agency, fiduciary, or other professional relationship between you and CREBB Group, and no such relationship is formed until a written agreement is signed by both parties.

Content on the Services is provided for informational purposes only and does not constitute real estate, legal, financial, tax, or investment advice. You should consult qualified professionals before making any decision based on information obtained through the Services. Real estate brokerage services are provided through eXp Commercial.

6. SMS / Text Messaging Program

CREBB Group offers an SMS/text messaging program (the “Program”) that allows us to communicate with you by text message. By providing your mobile phone number and opting in — whether through a web form, in person, in writing, or by texting us — you expressly consent to receive text messages from CREBB Group at the number provided. Consent to receive text messages is not a condition of purchasing any property, service, or good.

Types of messages and use cases

Once you opt in, you may receive text messages related to: appointment scheduling, confirmations, and reminders; responses to your inquiries and requests; property and business-for-sale listing information and updates; transaction coordination and follow-up; account or service notifications; and general customer care. Messages may be sent by a live agent or by automated technology.

Message frequency

Message frequency varies based on your interactions with us. You may receive recurring messages in connection with an active inquiry or transaction.

Message and data rates

Message and data rates may apply. Any fees are charged by and payable to your mobile service provider. Please contact your wireless carrier for details about your text or data plan.

How to opt out

You can cancel the Program at any time by replying STOP to any text message you receive from us. After you send “STOP,” we will send you a one-time confirmation message, and you will no longer receive text messages from the Program. If you want to rejoin, simply opt in again as you did initially.

Carriers and delivery

Carriers (including but not limited to AT&T, T-Mobile, Verizon, Sprint, and their affiliates) are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your wireless carrier and is not guaranteed.

Your privacy

Information you provide in connection with the Program is handled in accordance with our Privacy Policy. We do not share, sell, or rent your mobile opt-in information or consent to any third parties or affiliates for their marketing or promotional purposes.

7. Property Listings and Third-Party Information

Property listings, business-for-sale listings, valuations, square footage, pricing, availability, and other details displayed on the Services may be obtained from third parties, including multiple listing services, property owners, and other data providers. While we strive to present accurate and current information, we do not warrant the accuracy, completeness, or timeliness of any listing or related information. All information is subject to errors, omissions, changes, prior sale or lease, or withdrawal without notice. You should independently verify any information before relying on it.

8. Third-Party Links and Services

The Services may contain links to third-party websites, tools, or resources that are not owned or controlled by CREBB Group, including scheduling, mapping, and analytics services. We provide these links for your convenience only and do not endorse and are not responsible for the content, privacy practices, or availability of any third-party site or service. Your use of third-party sites and services is at your own risk and subject to their terms.

9. User Submissions

If you submit information, inquiries, documents, or other materials to us through the Services (for example, through contact, registration, referral, or upload forms), you represent that you have the right to provide such materials and that they are accurate. You grant CREBB Group a non-exclusive, royalty-free license to use such materials for the purpose of responding to your inquiry and providing the Services. Please review our Privacy Policy for information on how we handle personal information.

10. Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CREBB GROUP DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY INFORMATION OBTAINED THROUGH THE SERVICES WILL BE ACCURATE OR RELIABLE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CREBB GROUP, ITS OWNERS, MEMBERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify, defend, and hold harmless CREBB Group and its owners, members, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

13. Governing Law

These Terms and any dispute arising out of or related to them or the Services shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Ohio, and you consent to the personal jurisdiction of such courts.

14. Changes to These Terms

We may revise these Terms from time to time in our sole discretion. The updated version will be indicated by an updated “Last updated” date at the top of this page. Your continued use of the Services after any changes become effective constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

15. Termination

We may suspend or terminate your access to the Services at any time, without notice or liability, for any reason, including if we believe you have violated these Terms. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — shall survive.
